Editorial:मध्यप्रदेश राजपत्र में जारी इन नए नियमों से आम जनता को कानूनी लड़ाइयों और अदालती कार्यवाही में बड़े स्तर पर फायदा होगा। पहले डिजिटल सबूतों को लेकर कोई स्पष्ट और सुरक्षित केंद्रीकृत व्यवस्था नहीं थी, जिससे आम नागरिकों को कई तरह की परेशानियों का सामना करना पड़ता था। पुराने सिस्टम के मुकाबले अब किए गए मुख्य बदलाव और उनसे होने वाले फायदे इस प्रकार हैं:

पहले क्या था और अब क्या बदलाव किए गए हैं

पहले कोर्ट में पेन ड्राइव, सीडी या मोबाइल जैसे डिजिटल सबूत सीधे पेश कर दिए जाते थे, जिससे उनके खोने, खराब होने या उनके साथ छेड़छाड़ (टैंपरिंग) होने का खतरा बहुत ज्यादा रहता था। अब नई व्यवस्था में उच्च न्यायालय द्वारा एक विशेष 'सुरक्षित संग्रह' (सिक्योर रिपोजिटरी) बनाया गया है, जहां सभी डिजिटल सबूतों को पूरी तरह सुरक्षित रखा जाएगा।

पहले जांच अधिकारियों या अन्य स्तरों पर डिजिटल सबूतों की कॉपी बनाते समय डेटा बदलने की गुंजाइश रहती थी। अब नए नियमों में 'हैश मान' (हैश वैल्यू) और 'मिरर इमेज' को अनिवार्य किया गया है। जब भी कोई सबूत पोर्टल पर अपलोड होगा, उसका हैश मान दर्ज हो जाएगा। इससे यह सुनिश्चित होगा कि सबूत के साथ भविष्य में एक बिंदु का भी बदलाव नहीं किया जा सकेगा।

पहले संवेदनशील या महिला अपराधों से जुड़े मामलों के डिजिटल सबूतों (जैसे वीडियो या चैट) के सार्वजनिक होने या लीक होने का डर रहता था, जिससे पीड़ित को मानसिक प्रताड़ना झेलनी पड़ती थी। अब नए नियमों में कड़े प्रावधान किए गए हैं कि यौन अपराधों से पीड़ित व्यक्तियों की पहचान उजागर करने वाला कोई भी इलेक्ट्रॉनिक साक्ष्य सीधे पोर्टल पर अपलोड नहीं हो सकेगा। साथ ही संवेदनशील फाइलों को केवल 'रीड ओनली' मोड में दिया जाएगा, जिससे कोई उन्हें चुरा या बदल नहीं सकेगा।

पहले कोर्ट में जमा किए गए कंप्यूटर, हार्ड डिस्क या मोबाइल धूल, नमी या चुंबकीय प्रभाव के कारण अक्सर खराब हो जाते थे, जिससे पीड़ित पक्ष का मुख्य सबूत ही नष्ट हो जाता था। अब सख्त नियम बनाया गया है कि मूल इलेक्ट्रॉनिक उपकरणों को एंटी-स्टेटिक और चुंबकीय प्रभावरोधी लिफाफों में बंद करके पूरी तरह से सुरक्षित और विसंक्रमित वातावरण (कंट्रोल एनवायरनमेंट) में रखा जाएगा।

आम नागरिकों को अब अदालतों के चक्कर नहीं काटने पड़ेंगे और उनके मामलों का निपटारा तेजी से होगा। पहले डिजिटल साक्ष्यों की सत्यता जांचने और उनकी प्रामाणिकता साबित करने में सालों लग जाते थे, लेकिन अब प्रमाणित पोर्टल, तय हैश वैल्यू और सीधे एक्सपर्ट जांच की सुविधा से मुकदमों की गति तेज होगी।

आम जनता के सबूत अब पूरी तरह सुरक्षित रहेंगे। नागरिकों को यह डर नहीं रहेगा कि थाने या कोर्ट के मालखाने में रखा उनका कीमती डेटा या मोबाइल खराब हो जाएगा या गायब हो जाएगा।

इस पूरी व्यवस्था से न्याय प्रणाली में पारदर्शिता आएगी। डिजिटल साक्ष्यों के रख-रखाव की पूरी चेन ऑनलाइन और रिकॉर्डेड होगी, जिससे पुलिस या विरोधी पक्ष द्वारा सबूतों को मिटाने या बदलने की संभावना पूरी तरह खत्म हो जाएगी।

These new rules issued in the Madhya Pradesh Gazette will greatly benefit the general public in legal battles and court proceedings. Previously, there was no clear and secure centralized system for digital evidence, causing various difficulties for ordinary citizens. What it was before vs What has changed now

Previously, digital evidence such as pen drives, CDs, or mobile phones were presented directly in court, which carried a very high risk of being lost, damaged, or tampered with. In the new system, a special 'Designated Secure Repository' has been established by the High Court, where all digital evidence will be kept completely secure.

Previously, there was a risk of data modification while making copies of digital evidence by investigating officers or at other levels. Now, 'Hash Value' and 'Mirror Image' have been made mandatory in the new rules. Whenever any evidence is uploaded to the portal, its hash value will be recorded. This ensures that not even a single point of the evidence can be altered in the future.

Previously, there was a fear of digital evidence (such as videos or chats) related to sensitive cases or crimes against women being leaked or made public, causing mental harassment to the victim. Now, strict provisions have been made in the new rules that no electronic record disclosing the identity of victims of sexual offenses can be uploaded directly to the portal. Additionally, sensitive files will be provided only in 'Read Only' mode, preventing anyone from stealing or altering them.

Previously, computers, hard disks, or mobiles submitted to the court often got damaged due to dust, moisture, or magnetic effects, destroying the primary evidence of the aggrieved party. Now, a strict rule has been made that the original electronic devices must be kept in anti-static and magnetic-proof envelopes and preserved entirely in a secure and decontaminated environment (controlled environment).

Main Benefits to the General Public

Ordinary citizens will no longer have to run in circles around the courts, and their cases will be resolved faster. Previously, it took years to verify the truthfulness and establish the admissibility of digital evidence, but now, with a certified portal, fixed hash values, and direct expert investigation facilities, the pace of trials will accelerate.

The evidence of the general public will now remain completely safe. Citizens will no longer fear that their valuable data or mobile phones kept in police stations or court store rooms (malkhana) will get damaged or go missing.

This entire system will bring transparency to the justice delivery system. The entire chain of custody and maintenance of digital evidence will be online and recorded, completely eliminating the possibility of the police or the opposing party destroying or altering the evidence.
