Welcome to Gamaki Media (https://gamakimedia.in/). This website is owned and operated by Gamki Media Pvt. Ltd. (hereinafter referred to as "the Company", "We", "Us", or "Our"). By accessing our website, subscribing to our services, or making financial contributions via our "Support Us" program, you (the "User", "Reader", or "Contributor") agree to be legally bound by the following Terms of Service.

If you do not agree to these terms, you must immediately cease using this website.

1. Legal Compliance & User Eligibility

By agreeing to these Terms, you represent that you are at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.   • Prohibition: You are strictly prohibited from copying, reproducing, modifying, redistributing, publishing, or creating derivative works from our content without explicit, prior written consent from the Company. Any unauthorized use will result in immediate legal action and claims for damages.

3. Reader Revenue, Subscriptions, and Contributions ("Support Us")

The Company utilizes Google Reader Revenue Manager and associated payment pathways to accept voluntary subscriptions and contributions from readers to keep our journalism independent.

  • Nature of Funds: Gamaki Media is a Private Limited agency and operates as a commercial entity. Any funds, financial support, or contributions made by users through our "Support Us" initiative or Google Reader Revenue Manager are strictly voluntary contributions to support independent journalism. These are NOT treated as charitable donations.

  • 80G Tax Exemption Disclaimer: Please note that all contributions/payments made to Gamaki Media are NOT tax-exempt under Section 80G or any other charitable provisions of the Income Tax Act, 1861. By contributing, you explicitly acknowledge that you will not receive a tax-exemption certificate for your payment.

  • No-Refund Policy: All payments, subscriptions, and voluntary financial contributions made to Gamaki Media are final and completely non-refundable under any circumstances. Subscription cancellations will apply to the next billing cycle, and no partial refunds for the current period will be issued.

  • Billing Accuracy: You agree to provide accurate, current, and complete payment details. All transactions are subject to the terms of our third-party payment processors.

4. Editorial Discretion, Limitation of Liability & Indemnification

  • Corporate Editorial Standards: Gamaki Media operates as a professional corporate media house. All news, reports, editorials, opinions, and analysis published on the website undergo our internal editorial processes. However, all content is provided on an "As Is" and "As Available" basis. The Company makes no express or implied warranties regarding the absolute accuracy, completeness, or timeliness of the information for any specific commercial or legal purpose.

  • Limitation of Corporate Liability: In no event shall the corporate entity of Gamaki Media, its board of directors, shareholders, editors, journalists, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of business, reputation, or data, arising out of your reliance on our news coverage or use of the website.

  • Indemnification: You agree to indemnify, defend, and hold harmless the Company and its management from and against any and all claims, liabilities, damages, losses, or legal expenses arising out of your breach of these Terms, misuse of our platform, or any legal action triggered by your comments or interactions on our published content.

  • Force Majeure & Technical Interruptions: As a digital media network, the Company shall not be held liable for temporary downtime, website outages, cyber-attacks, or data breaches caused by factors beyond our reasonable corporate control.

5. Governing Law and Corporate Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal disputes, claims, or proceedings arising out of our news publication, reader revenue programs, contributions, or any corporate operations of Gamaki Media shall be subject to the exclusive jurisdiction of the competent courts located in Betul, Madhya Pradesh, India

6. Modifications to the Agreement

The Company reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
