बिलासपुर: छत्तीसगढ़ हाई कोर्ट ने हिंदू धर्म को लेकर कथित तौर पर आपत्तिजनक टिप्पणी करने के मामले में 11 सामाजिक कार्यकर्ताओं के खिलाफ दर्ज आपराधिक कार्यवाही और एफआईआर को रद्द करने से इनकार कर दिया है। मुख्य न्यायाधीश रमेश सिन्हा और न्यायमूर्ति रवींद्र कुमार अग्रवाल की खंडपीठ ने याचिका को खारिज करते हुए स्पष्ट किया कि इस मामले से जुड़े तथ्यों और साक्ष्यों की जांच केवल ट्रायल (मुकदमे) के दौरान ही की जा सकती है, इसलिए शुरुआती चरण में एफआईआर को खारिज नहीं किया जा सकता। न्यायालय ने याचिकाकर्ताओं द्वारा दी गई 'अभिव्यक्ति की आजादी' की दलील पर कहा कि इसका निर्धारण भी निचली अदालत में ट्रायल के दौरान ही देखा जाएगा।
यह पूरा मामला फरवरी 2024 का है, जब जशपुर के कुनकुरी में भारत मुक्ति मोर्चा और राष्ट्रीय क्रिश्चियन मोर्चा द्वारा आयोजित एक सार्वजनिक सभा में कथित तौर पर हिंदू धर्म, देवी-देवताओं और कुछ विशिष्ट समुदायों के खिलाफ अपमानजनक बातें कही गई थीं। इस संबंध में विश्व हिंदू परिषद के जिला अध्यक्ष कर्नैल सिंह ने शिकायत दर्ज कराई थी, जिसमें आरोप लगाया गया था कि वक्ताओं के भाषणों से सांप्रदायिक सौहार्द और राष्ट्रीय एकता को ठेस पहुंच सकती थी। इसके बाद पुलिस ने कुल 12 लोगों के खिलाफ भारतीय दंड संहिता (IPC) की धारा 153A, 153B, 295A, 505(2), 294 और 34 के तहत मामला दर्ज कर कोर्ट में चार्जशीट दाखिल की थी, जिसे सेशन कोर्ट ने भी बरकरार रखा था।

अभियोजन और कोर्ट का रुख: इसके विपरीत, अभियोजन पक्ष ने याचिका का कड़ा विरोध करते हुए दलील दी कि इन बयानों को सामान्य या अलग करके नहीं देखा जा सकता। बयान के समय मौजूद जनसमूह, कानून-व्यवस्था और सांप्रदायिक सौहार्द पर इसके संभावित गंभीर प्रभावों का संज्ञान लेना आवश्यक है।
दोनों पक्षों को सुनने के बाद, हाई कोर्ट ने स्पष्ट किया कि मामले की संवेदनशीलता और साक्ष्यों की सत्यता का फैसला केवल निचली अदालत में विस्तृत ट्रायल (मुकदमे) के माध्यम से ही संभव है। हाई कोर्ट द्वारा याचिका खारिज किए जाने के बाद अब इन सभी आरोपियों के खिलाफ निचली अदालत में तय धाराओं के तहत कानूनी कार्यवाही जारी रहेगी।
Chhattisgarh High Court Declines to Quash Criminal Proceedings Against 11 Activists of Christian Organizations Over Controversial Remarks
Bilaspur: The Chhattisgarh High Court has refused to quash the criminal proceedings and FIR registered against 11 social activists accused of making allegedly objectionable remarks regarding the Hindu religion. Dismissing the petition, a division bench comprising Chief Justice Ramesh Sinha and Justice Ravindra Kumar Agrawal clarified that the evaluation of facts and evidence in this case can only be conducted during a full trial. The bench stated that the FIR cannot be dismissed at this initial stage and noted that the petitioners' claims regarding the 'freedom of speech and expression' will also be examined by the trial court during the proceedings.
The matter dates back to February 2024, when Karnail Singh, the Jashpur District President of the Vishva Hindu Parishad, filed a complaint at the Kunkuri police station. According to the complaint, speakers at a public gathering organized by the Bharat Mukti Morcha and the Rashtriya Christian Morcha at the Saliatoli Mini Stadium in Kunkuri on February 27, 2024, made derogatory remarks against the Hindu religion, deities, and the Brahmin community. The speeches also reportedly contained comments concerning religious orator Dhirendra Shastri, the Chief Minister of Chhattisgarh, and calls to oppose and destroy Electronic Voting Machines (EVMs). The prosecution alleged that these speeches had the potential to promote enmity between different communities and disrupt communal harmony.
